3. Nature of Second-Hand Goods & Condition Disclaimer
aspr. sells second-hand, vintage, and pre-owned fashion items. All items are one-of-one, limited in quantity, and not new. You expressly acknowledge and agree that:
Items may show visible signs of wear, aging, repair, alteration, or other characteristics consistent with age and prior use
Such characteristics are inherent and expected in second-hand and vintage goods and do not constitute defects
Manufacturer warranties do not apply and are expressly disclaimed
Items are sold in their current condition, including any cosmetic imperfections
This disclaimer applies to normal wear and characteristics of pre-owned items. It does not exclude liability for hidden defects, material misrepresentation of condition, or defects that would not be apparent from professional inspection. In the event of a dispute, aspr. retains the right to re-examine the item in question.
4. Product Descriptions, Curation & Research
Product descriptions, measurements, photographs, condition notes, and fashion history research are provided in good faith based on visual inspection, professional expertise, academic research, and available reference materials.
Our Research Catalogue provides historical context, curatorial analysis, and fashion scholarship. This content represents aspr.'s professional and intellectual work and is proprietary. It is provided solely to contextualize our collection items and enhance customer understanding.
Despite reasonable care, minor inaccuracies, omissions, or differences may occur. Colors, textures, and details may vary due to lighting, screen calibration, photography angle, or material aging. Measurements may have minor variances (typically ±0.5 inches).
All items are subject to availability. We reserve the right to correct pricing errors, update listings, or cancel orders if an item is unavailable or mispriced, to the extent permitted by law.
5. Pricing, Orders & Cancellations
All prices are listed in the currency indicated on the Website and exclude applicable taxes, duties, customs fees, and shipping costs unless otherwise stated.
Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion. An order is not accepted until we send you an order confirmation email.
Once an order is placed and confirmed, it may only be modified or cancelled at our sole discretion or as required by law. If you wish to cancel an order, please contact us immediately at contact@aspr.shop with your order details.
6. Payment Processing & Third-Party Services
Payment processing is handled by third-party providers, including but not limited to Stripe, PayPal, Shopify Payments, and other integrated payment platforms. aspr. does not directly store, process, or retain credit card information. Payment processing is governed by the terms and privacy policies of the applicable third-party provider.
We are not liable for errors, delays, declines, or failures attributable to third-party payment processors, card issuers, or financial institutions. If payment fails, please contact your financial institution or payment provider for assistance.
7. Refund Policy & Dispute Resolution
All sales are final. To the maximum extent permitted by applicable law:
Refunds are not issued to the original payment method
Returns are not accepted
Exchanges are not offered
In rare circumstances and solely at aspr.'s discretion, we may offer store credit as a gesture of goodwill. Store credit is non-transferable, non-refundable, expires 12 months from issuance, and may be subject to additional conditions.
QUEBEC CONSUMER RIGHTS: Under Quebec's Law on Consumer Protection (Loi sur la protection du consommateur), you may have the right to cancel a remote purchase within 30 days of receiving the item. This right may be limited or modified for certain goods, including second-hand items sold as-is. To the maximum extent permitted by law, we disclaim liability for differences of opinion regarding authenticity. If you dispute the authenticity of an item within 14 days of receipt, please contact us with documentation. We will evaluate your claim in good faith.
9. Shipping, Customs & International Orders
We ship domestically within Canada and internationally to most countries. You are solely responsible for:
Providing accurate, complete shipping information
Understanding and paying all applicable customs duties, import taxes, VAT, GST/HST, brokerage fees, and other governmental charges
Ensuring compliance with local import laws and restrictions in your jurisdiction
Understanding that certain items may be subject to import restrictions or prohibitions
International shipments may experience delays, inspection, or seizure by customs authorities. aspr. is not responsible for delays caused by customs, additional costs imposed by third parties or governments, or packages seized by authorities. If a package is seized, we will work with you to provide necessary documentation, but we cannot guarantee recovery.
Risk of loss and liability transfer to you upon shipment, except where such transfer is prohibited by applicable law. We strongly recommend purchasing shipping insurance for high-value items.
10. Limitation of Liability
To the maximum extent permitted by applicable law:

Our total liability shall not exceed the amount you paid for the item in question

You agree to indemnify, defend, and hold harmless aspr., its owners, operators, and affiliates from any claims, losses, damages, liabilities, and costs (including reasonable legal fees) arising from:

Fraudulent claims, chargebacks, or payment disputes initiated by you
Your violation of applicable laws or infringement of third-party rights

12. Intellectual Property Rights & Content Protection
